Top Hat Jerky – Terms of Use and Sale

Welcome to Top Hat Jerky! We’re a small, family-owned business, and we appreciate you visiting our website (the “Site”). These Terms of Use (“Terms”) govern your use of our Site and the purchase of our products online. By using our Site or placing an order, you agree to these Terms and our Privacy Policy. If you don’t agree, please don’t use the Site.

Who We Are & Ownership

This Site is owned and operated by Top Hat Jerky (“we,” “us,” “our”). All content on the Site, including text, graphics, images, and logos, belongs to us or is used with permission. You may view and print parts of the Site for personal, non-commercial use, but you can’t copy, distribute, or use our content for commercial purposes without our written permission.

Your Use of the Site

You agree not to use the Site for any unlawful purpose or in a way that disrupts others’ use. Please don’t post or share content that is offensive, misleading, or infringes on others’ rights. If you submit feedback or suggestions to us, we may use them freely without obligation to you.

Orders, Payment & Acceptance

When you place an order, it’s an offer to buy our products under these terms. We may accept or decline orders at our discretion. Prices, promotions, and availability are subject to change without notice.

We accept major credit cards, Apple Pay, and Google Pay. By providing payment, you confirm the information is accurate and that you’re authorized to use that payment method.

Shipping & Delivery

We currently ship within the United States only. Shipping costs are shown at checkout. Title and risk of loss pass to you once the package is given to the carrier. Delivery dates are estimates, and while we do our best, we can’t guarantee shipping times.

Returns & Refunds

Because we sell food products, all jerky sales are final and non-returnable for safety reasons. If your order arrives damaged, incorrect, or otherwise unsatisfactory, please contact us at sales@tophatjerky.com within 14 days of receiving it. We may offer a replacement or refund at our discretion.

Subscriptions

If you sign up for a subscription, you agree that we’ll charge your chosen payment method on a recurring basis until you cancel. You may cancel anytime through your account page, but any order already processed or shipped cannot be cancelled or refunded.

Warranties & Disclaimers

Our products are sold “as is” and “as available.” While we take pride in our quality, we can’t promise the Site or products will always be error-free or uninterrupted. To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.

Limitation of Liability

To the maximum extent permitted by law, Top Hat Jerky and its owners, employees, and agents shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or our products. If liability is found, it will not exceed the total amount you paid for the product(s) in question.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California. If a disagreement arises, we ask that you contact us first to try to resolve it informally. If we cannot resolve it, both you and Top Hat Jerky agree to settle the matter through binding arbitration on an individual basis (not as a class action) or in small claims court if eligible.

Changes to These Terms

We may update these terms occasionally. The “Effective Date” above reflects the latest version. Continued use of the Site after changes means you accept the updated Terms.

Entire Agreement

These Terms, together with our Privacy Policy, are the full agreement between you and Top Hat Jerky regarding your use of the Site.
